Overview
Lifeguarding International Terms & Conditions and Cancellation Policies are publicly published on lifeguardcertifications.com. These Terms & Conditions and Cancellation Policies are legally binding and apply to all purchases.
Defined terms under this Agreement:
“Minors” – shall mean the following minors who are the children, foster children, wards or otherwise legal responsibility of the Participants.
“Released Parties” – shall mean Lifeguarding International and its subsidiaries and parent companies and each of the above-named parties’ partners, officers, directors, committee chairpersons, committee members, agents, management company(s), contractors, employees, servants, successors or assigns.
“Pool” – shall mean the swimming pool being used for the “Participants”.
“Participants” – shall mean each signatory to this document and each signatory’s Minor Participants, heirs, successors, representatives and assigns.
“Authorized Training Center” – shall mean the legally incorporated entity authorized, according to the ATC Contract, by Lifeguarding International to deliver Lifeguarding International courses to consumers.
“Authorized Instructor” – shall mean the person certified as a Lifeguarding International Lifeguard Instructor and authorized, according to the ATC Contract and under the supervision of a Lifeguarding International Authorized Training Center, by Lifeguarding International to deliver Lifeguarding International courses to consumers.
Types of Goods & Delivery. The content and information contained in the Lifeguarding International Courses is proprietary. Attendance at a Lifeguarding International Course grants access to Lifeguarding International proprietary information. Courses are non-refundable once a consumer attends any portion of a Lifeguarding International Course.
The Courses are services provided directly by Lifeguarding International Authorized Training Centers (ATC’s). You must know and understand the terms and conditions as published by each Authorized Training Center as they are not employees of Lifeguarding International and are, instead, independent businesses. If you are seeking a refund for a Course, you must directly contact the Authorized Training Center (ATC) with whom you registered to participate in the Course.
Cost, access and use of any and all Lifeguarding International proprietary materials by Lifeguarding International Authorized Training Centers and/or Authorized Instructors is strictly governed and agreed upon in the ATC Contract.
Right to Cure. Customer agrees to email all service and product related concerns to Lifeguarding International at admin@lifeguardinginternational.com before initiating a chargeback or requesting a refund and further agrees to afford Lifeguarding International three (3) calendar days to repair or replace the service and/or product.
Hold Harmless:
1.) In exchange for being permitted to use the services of Lifeguarding International and for other good and valuable consideration, the sufficiency of which is hereby acknowledged, the undersigned Participants, for himself/herself/theirself, release and agree not to make or bring any claim of any kind against the Released Parties for: (1) any injury (including death), disease or sickness to Participants, Minors or their guests and invitees related to the use of the services of Lifeguarding International; (2) any damage to personal property whether or not caused by the negligence of the Released Parties or not; or (3) any other cause arising out of or related to Participants, Minors or their guests and invitees use of the services of Lifeguarding International.
2.) In consideration for being allowed to use the services of Lifeguarding International under this Agreement, and for other good and valuable consideration, the sufficiency of which is hereby acknowledged:
PARTICIPANTS AGREE TO INDEMNIFY AND HOLD THE RELEASED PARTIES HARMLESS FROM LIABILITY OR CLAIMS, DEMANDS, DAMAGES AND COSTS FOR OR ARISING OUT OF: (1) ANY DAMAGE, INJURY, DISEASE, SICKNESS OR DEATH TO PARTICIPANTS OR THEIR MINORS, GUESTS OR INVITEES RELATED TO THE USE OF THE SERVICES OF LIFEGUARDING INTERNATIONAL; OR (2) ANY DAMAGE OR LOSS TO PERSONAL PROPERTY CAUSED BY OR RELATED TO THE USE OF THE SERVICES OF LIFEGUARDING INTERNATIONAL.
PARTICIPANTS UNDERSTAND, ACKNOWLEDGE AND STIPULATE THAT THIS INDEMNITY AGREEMENT INCLUDES ANY SUCH CLAIMS, DEMANDS, DAMAGES AND COSTS ARISING OUT OF NEGLIGENCE ON THE PART OF THE RELEASED PARTIES.
3.) Participants stipulate and agree that invalidation of any term(s) or provision(s) of this Agreement by judgment or other court order shall not affect any of the other terms or provisions and such other terms and provisions shall remain in full force and effect.
RELEASE OF LIABILITY. The buyer, student, the student’s heirs, and legal designees agree to hold harmless Lifeguarding International, its owners, employees, agents, contractors, and instructors from any and all acts, errors, and omissions committed by the student while serving as a certified Lifeguard Instructor, Lifeguard, Lifeguard cardholder, or cardholder of any other guarding International certification. Lifeguarding International certification only signifies that the cardholder (student) has successfully completed the Lifeguarding International certification course according to the Lifeguarding International Quality Assurance Guidelines, appropriate course outline and manual and as verified by the Lifeguarding International Authorized Training Center (ATC) on the date(s) of the course and the testing of the objectives.
ADA COMPLIANCE POLICIES: Effective January 26, 1992, the Americans with Disabilities Act (ADA) bars discrimination against persons with disabilities in places of public accommodation. Title III of the law bars private entities (schools, banks, restaurants, social service agencies, offices, retail sales establishments, etc.) from discriminating against individuals with disabilities in the provision of their goods and services. Individuals with qualifying physical or mental disabilities will not be denied participation in the goods, services, facilities, advantages or accommodations offered to the public. As a place of public accommodation, we will not discriminate against any patrons, clients, invitees or guests on the basis, of real or perceived qualifying disabilities.
Specifically:
• We will allow access to anyone seeking admission to a course (provided prerequisites are satisfied) regardless of real or perceived inability to participate in or pass the course.
• We will allow participants in every course to participate within the limits of their ability and learn as much as they can. For some people, certification may not be important. For those individuals, focus on helping them to learn as much as possible.
• If there is a request for accommodation, we will discuss possible solutions with the individual or his or her guardian, and if the individual prefers and provides permission, a medical provider. Accommodations may need to be arranged in advance and will be done so in compliance with all federal, state and local laws. We may not provide the accommodation preferred by the individual as, long as the accommodation offered is reasonable (i.e., building a permanent ramp into a pool versus using a swing-arm harness). We will seek to first cover the costs for reasonable accommodation without a surcharge, but may offer the option for students to pay a portion or all, of unreasonable accommodations if they should choose.
• We will certify each participant who can meet course skill and knowledge testing objectives.
• We will use available resources to assist people with special needs.
I agree to all Terms & Conditions and Cancellation Policies as outlined in this document. I agree to the charges for the purchase I am making. I further understand and agree to Dynamic Education Services LLC (dba: Lifeguarding International) charging my credit card and/or debit card for the total amount of the goods and services I have agreed to purchase.
Refunds
Once your return is received and inspected, we will send you an email to notify you that we have received your returned item. We will also notify you of the approval or rejection of your refund.
If you are approved, then your refund will be processed, and a credit will automatically be applied to your credit card or original method of payment, within a certain amount of days.
Late or missing refunds
If you haven’t received a refund yet, first check your bank account again.
Then contact your credit card company, it may take some time before your refund is officially posted.
Next contact your bank. There is often some processing time before a refund is posted.

Sale items
Only regular priced items may be refunded. Sale items cannot be refunded.
Exchanges
We only replace items if they are defective or damaged. If you need to exchange it for the same item, send us an email at admin@lifeguardinginternational.com and send your item to: P.O. Box 10165 Baltimore, MD 21285.
Shipping returns
To return your product, you should mail your product to: P.O. Box 10165 Baltimore, MD 21285.
You will be responsible for paying for your own shipping costs for returning your item. Shipping costs are non-refundable. If you receive a refund, the cost of return shipping will be deducted from your refund.
Depending on where you live, the time it may take for your exchanged product to reach you may vary.
If you are returning more expensive items, you may consider using a trackable shipping service or purchasing shipping insurance. We don’t guarantee that we will receive your returned item.
